Key Takeaways

  • GSTAT established for cost-effective tax dispute resolution
  • Over 8,000 registrations indicate strong demand
  • Experts stress importance of clear communication and drafting

Not because everything will magically become easy, but because at least there is now dedicated forum meant to hear GST appeals in more cost-effective way .

This whole discussion came up during national conference organized by PHD Chamber of Commerce and Industry (PHDCCI) ,where experts spoke about operationalization of GSTAT and what it may change for taxpayers dealing with GST disputes.

Justice (Retd) Sanjaya Kumar Misra , President of GSTAT,made one point very clear . People appearing before Tribunal need to come prepared, keep professionalism and present cases properly . Basically,Tribunal may be taxpayer-friendly in approach, but that does not mean casual paperwork will work.

And tbh,the phrase “Appellate Devo Bhava” really stood out here . Justice Misra said this is guiding principle of GSTAT,meaning appellants should be treated with respect and their appeals should be handled fairly and without bias.

He also reassured stakeholders that minor procedural lapses will not block adjudication on merits,as long as essential documents are submitted . That is not small thing ah,because many genuine cases get stuck only because of technical mistakes.

Few things standing out clearly from conference:

  • Focus on legal certainty — success of GSTAT will be measured by number of cases resolved and legal clarity provided.
  • Automation and improvements — committee has been formed to enhance GSTAT portal, with focus on increased automation.
  • Need for effective litigation — experts emphasized sound drafting and strong factual presentation for successful appeals.

At same time, volume already looks heavy . GSTAT portal has over 8,000 registrations and approximately 11,400 appeals filed,so expecting instant disposal may be unrealistic in initial phase . It may take time before system settles properly .

Pramod Kumar Rai ,Judicial Member of GSTAT,also gave practical advice . He said statements of facts must be clear and relevant grounds should be discussed in detail to make appeals stronger . Simple point, but many litigants and consultants know this is where cases often become weak.

Experts on panel also said successful litigation needs strategic approach, proper communication, strong drafting and deep understanding of issues involved . And honestly, this is where taxpayers may need to be careful, because good case badly presented can still suffer.

So yes, there is optimism that GSTAT can make GST dispute resolution more efficient and fair in India . But with thousands of appeals already waiting, the real question is how smoothly this promise will work when daily pressure of cases starts building…
