This Karnataka High Court order is not easy news to react to, honestly . Because it is about medicine,consent,disability,parents’ fear and court stepping into one deeply personal health decision.
A 23-year-old woman with severe intellectual and developmental disabilities has been allowed to undergo total abdominal hysterectomy at Vanivilas Hospital in Bengaluru . Permission was granted by Karnataka High Court through ruling delivered by Justice Suraj Govindaraj.
And case came before court because her parents approached it,asking permission for surgery they believed was needed for their daughter’s health . This was not treated like routine hospital decision,which is actually main thing here.
Court formed multi-disciplinary medical board with specialists from psychology,psychiatry,gynecology and other fields to examine her condition and need for procedure . Their assessment said she suffers from Global Developmental Delay and has cognitive ability equivalent to child of approximately five years.
And honestly,this is where matter becomes very sensitive.

Justice Suraj Govindaraj noted decision was not made lightly . Since patient could not give informed consent due to severe disabilities,court had to look at medical opinion,health risks and whether surgery was really in her best interests .
The ruling also mentioned menstrual hygiene-related health risks,which parents and doctors were trying to manage . Not small thing ah,because for person who cannot fully understand or manage her own body needs,daily care can become very difficult and painful for family also.
But at same time,this kind of order naturally makes people think about consent and dignity . Court checked that there were no contraindications to proposed procedure and told medical superintendent of Vanivilas Hospital to arrange surgery along with pre and post-operative counseling.
And maybe that is why this case feels heavy . It is compassionate on one side,but also uncomfortable because someone’s body,health and future are being decided by parents,doctors and court together… where exactly line should be drawn in such cases…
