Supreme Court just gave one very strong message on June 2,2026, and it's making everyone talk . They basically said when there's a "war" against the nation through drugs,personal liberty cannot be the top priority.
This whole thing is about a guy named Balraj Singh,also known as Billa,who was caught in a case with 1.465 kg of heroin . That is not small quantity ah. The Punjab and Haryana High Court had given him bail,but now the SC has cancelled it .
The original FIR was filed way back in January 2024 in Punjab's Tarn Taran district . Police found heroin on two other people,but their investigation led them to Balraj Singh . They claimed he was running whole drug trafficking network from inside Central Jail,Goindwal Sahib,using illegal mobile phones.
And honestly,this is where the whole thing gets complicated.
The High Court had granted him bail in October 2025 . Their reasoning was basically that he had been in custody for some time and trial could take long time . But Punjab government didn't agree and they went to Supreme Court .
Few things standing out from the SC's decision:
- The court clearly said personal liberty can't outweigh national interests in big drug cases.
- They pointed out that lower courts must follow strict rules of Section 37 of the NDPS Act for bail.
- Singh’s past criminal record under same drug laws was a major factor in cancelling bail.
And the SC bench,led by Justice Sanjay Karol,was very clear that you can't have a liberal approach when such a huge amount of narcotics is involved . They said the High Court didn't properly consider the NDPS Act's strict rules.
But the argument about him being in jail for long time was also shut down . court noted he had only been inside for one year and seven months,while crime he is accused of could get him up to 20 years in prison. So that argument didn't work.
This ruling is pretty big tbh . It sets a very tough tone for drug-related cases,especially when large quantities are involved. court is putting national sovereignty and safety first.
It really makes you think about the balance between individual rights and the larger security of country... where do you draw the line…
